1. Agreement to Terms

Welcome to Jobtepi ("we," "us," "our," or "Platform"). By accessing or using the Jobtepi web platform and mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and Jobtepi. Please read them carefully.

2. Definitions

Platform

The Jobtepi web platform, mobile application, and all related services

User

Any person who accesses or uses the Platform

Buyer

A User who purchases services or products

Seller

A User who offers services, gigs, or digital products

Gig

A service offering created by a Seller

Digital Product

Downloadable content offered by a Seller

Community

A group or space created for user interaction

Order

A transaction between a Buyer and Seller

3. Eligibility

All Users Must:

Be at least 18 years of age
Have the legal capacity to enter into binding contracts
Not be prohibited from using the Platform under Malaysian law
Provide accurate and complete registration information
Have a valid email address and phone number

For Sellers, Additional Requirements:

Possess the skills and qualifications for services offered
Provide valid IC number and bank account information
Comply with Malaysian business and tax regulations
Have the legal right to sell offered products or services

4. Account Registration and Security

4.1 Account Creation

You must create an account to access most Platform features. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of unauthorized access
• Be responsible for all activity under your account

For purchasing services and products

Seller Account

For offering services and products (requires onboarding and verification)

One Account Per User

You may only maintain one active account. Multiple accounts may result in suspension.

4.4 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or harass other Users
• Provide false information
• Fail to resolve payment disputes

5. Seller Responsibilities

5.1 Seller Onboarding

To become a Seller, you must:

✓ Complete the seller onboarding process

✓ Provide valid identification (IC number)

✓ Provide business info and bank account

✓ Select your plan type

✓ Build your profile with portfolio

✓ Showcase skills and experience

5.2 Service and Product Listings

As a Seller, you must:

• Provide accurate descriptions of your services/products
• Set fair and transparent pricing
• Deliver services as described
• Respond to buyer inquiries promptly
• Maintain professional conduct
• Honor delivery timelines committed

5.3 Prohibited Services

Sellers may NOT offer services or products that:

• Violate Malaysian laws or regulations
• Infringe intellectual property rights
• Contain harmful, offensive, or adult content
• Involve illegal activities or substances
• Misrepresent qualifications or capabilities
• Promote violence, discrimination, or hate speech

5.4 Quality Standards

Sellers must:

• Deliver high-quality work that meets reasonable standards
• Accept and respond to feedback constructively
• Provide reasonable revisions as specified in pricing tiers
• Maintain professional communication
• Resolve disputes in good faith

6. Buyer Responsibilities

6.1 Placing Orders

As a Buyer, you agree to:

• Provide complete and accurate project requirements
• Pay for orders as agreed
• Communicate clearly with Sellers
• Respond to delivery submissions in a timely manner
• Provide constructive feedback

6.2 Payment Obligations

Buyers must:

• Pay all fees at the time of purchase
• Use legitimate payment methods
• Not dispute valid charges fraudulently
• Pay applicable platform fees

6.3 Acceptance and Revisions

• Review delivered work promptly
• Request revisions within the allowed revision count
• Accept work when satisfactory
• Provide specific feedback for revision requests

7. Pricing and Payments

7.1 Pricing Tiers

Sellers offer services in up to three tiers:

Basic

Entry-level service with core features

Standard

Mid-tier service with additional features

Premium

Comprehensive service with maximum features

Each tier includes: Price, Delivery time, Number of revisions, and Specific features/deliverables

7.2 Payment Processing

All payments are processed through Billplz, a certified Malaysian payment gateway:

• Payment Methods: FPX (Malaysian banks), credit/debit cards
• Currency: Malaysian Ringgit (MYR)
• Transaction Security: PCI DSS compliant

7.3 Platform Fees

Jobtepi charges platform fees on transactions:

• Service Fee: Platform commission on transaction value
• Payment Processing: As charged by Billplz
• Buyer Fee: May be included in total price
• Seller Fee: Deducted from earnings

Platform fees are non-refundable.

8. Refunds and Cancellations

8.1 Cancellation Policy

Before Work Begins

• Buyers may cancel for a full refund if Seller has not started

• Sellers may cancel with mutual agreement

After Work Begins

• Cancellations require mutual agreement

• Partial refunds may apply based on work completed

• Disputes handled through Platform resolution

8.2 Refund Policy

Gigs and Services:

• Refunds issued if Seller fails to deliver
• Refunds for work not matching description
• No refunds for subjective quality disputes (resolved through revisions)

Digital Products:

• No refunds once product is downloaded
• Refunds for technical issues (non-functional files)
• Refunds if product significantly misrepresented

Processing Time:

• Approved refunds processed within 7-14 business days

• Refunded to original payment method

8.3 Dispute Resolution

If you have a dispute:

1. Communicate directly with the other party
2. Contact Jobtepi Support at support@jobtepi.com
3. Provide relevant documentation (messages, files, screenshots)
4. Allow up to 7 business days for resolution
5. Our decision on disputes is final

9. Content Rewards Program

9.1 How It Works

Sellers can create content reward campaigns:

• Set budget and reward rate (per 1,000 views)
• Define content requirements (platforms, type, category)
• Creators submit content for review
• Rewards paid based on verified views

Creator Responsibilities

• Submit original content or have rights
• Provide accurate view counts
• Not manipulate engagement metrics
• Follow platform guidelines
• Report truthfully

Campaign Owner Rights

• Approve or reject submissions
• Request proof of views/engagement
• Pause or cancel campaigns
• Set specific content requirements

9.4 Payout Terms

• Rewards calculated based on verified metrics
• Minimum payout threshold: RM 50
• Payouts processed within 30 days of approval
• False reporting may result in account suspension

10. Communities and Social Features

10.1 Community Creation

Sellers can create communities with features like:

✓ Public or private settings

✓ Member management

✓ Product offerings & subscriptions

✓ Community apps (Announcements, Courses, Events)

10.2 Community Guidelines

All community members must:

• Respect other members
• Follow community-specific rules
• Not post spam, ads, or prohibited content
• Not harass, bully, or threaten others
• Report violations to moderators or Jobtepi

10.3 Community Moderation

Community owners and moderators may:

• Remove inappropriate content
• Ban or suspend members
• Set community rules
• Monitor activity

Jobtepi reserves the right to remove communities or content that violate these Terms.

11. Intellectual Property

11.1 User Content Ownership

You retain ownership of content you create and upload. By posting content, you grant Jobtepi:

• A worldwide, non-exclusive, royalty-free license
• To display, reproduce, and distribute your content
• For the purpose of operating and promoting the Platform
• This license ends when you delete the content

11.2 Platform Content

Jobtepi owns all rights to:

• Platform design, features, and functionality
• Jobtepi logo, trademarks, and branding
• Platform code, algorithms, and technology

You may not copy, modify, or create derivative works without permission.

11.3 Copyright Infringement

If you believe content violates your copyright:

1. Email notice to copyright@jobtepi.com
2. Include your contact information
3. Identify the copyrighted work
4. Specify the infringing content location
5. Provide a statement of good faith belief
6. Include your electronic or physical signature

We will investigate and take appropriate action.

12. Prohibited Activities

Account Violations

• Create fake or multiple accounts • Impersonate others • Share login credentials • Buy or sell accounts

Platform Misuse

• Circumvent fees by transacting off-platform • Manipulate reviews or ratings • Spam users • Scrape or harvest user data • Reverse engineer the Platform

Content Violations

• Upload malicious software • Post false or misleading information • Share confidential information without permission • Infringe on intellectual property rights

Payment Violations

• Use stolen payment methods • Engage in money laundering • Request refunds fraudulently • Avoid or manipulate platform fees

Legal Violations

• Violate any Malaysian laws • Engage in fraud or deceptive practices • Facilitate illegal activities • Violate international trade laws or sanctions

13. Disclaimers and Limitations of Liability

13.1 Platform "As Is"

Jobtepi is provided "as is" and "as available" without warranties of any kind, including:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

13.2 No Guarantee of Results

We do not guarantee:

• Quality of services provided by Sellers
• Success of transactions
• Availability of specific Sellers or services
• Resolution of disputes in your favor

13.5 Limitation of Liability

To the maximum extent permitted by law, Jobtepi shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Damages exceeding the fees paid to Jobtepi in the past 12 months

13.6 User Disputes

Jobtepi is not a party to transactions between Buyers and Sellers. Disputes are primarily between Users, though we may assist in resolution.

18. Dispute Resolution and Arbitration

18.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at legal@jobtepi.com to seek informal resolution.

18.2 Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict of law principles.

18.3 Arbitration Agreement

Any dispute arising from these Terms or the Platform shall be resolved through binding arbitration in accordance with the Malaysian Arbitration Act 2005, except:

• Disputes under RM 5,000 may be filed in small claims court
• Intellectual property disputes may be filed in court
• Emergency relief may be sought in court

18.5 Venue

If court proceedings are necessary, they shall be conducted in the courts of Kuala Lumpur, Malaysia.

19. General Provisions

19.1 Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and Jobtepi.

19.2 Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

19.3 Waiver: Failure to enforce any provision does not waive our right to enforce it later.

19.4 Assignment: You may not assign these Terms. We may assign our rights and obligations to another entity.

19.5 Force Majeure: We are not liable for delays or failures due to circumstances beyond our control (natural disasters, pandemics, government actions, technical failures).

19.6 Language: These Terms are provided in English. Translations may be provided for convenience, but the English version governs in case of conflict.
